American Legion Posts 45 and 316








This agreement entered into on this 17th day of May, 2012 by and between

The Cherokee County Board of Education, hereinafter referred to as the “School Board”


The American Legion Posts 45 and 316 and American Legion Auxiliary Units 45 and 316, hereinafter referred to as “American Legion.”

WHEREAS, the School Board’s mission is to enable all students to become contributing citizens who can communicate effectively, gather and use information, make responsible decisions and adapt to the challenges of the future, and

WHEREAS, one of the School Board’s Major System Priorities is to increase parental and community involvement through public engagement policies and practices that treat parents, businesses, community-based organizations and agencies, local institutions of higher learning and other public entities as true partners in the educational process, and

WHEREAS, the American Legion was chartered by Congress in 1919 as a patriotic, mutual-help, war-time veterans organization, and

WHEREAS, the American Legion is a community service organization which now numbers nearly 3 million members in nearly 15,000 Posts worldwide (over 500 members in Posts 45 and 316).

Now therefore in consideration of the covenants and conditions set forth herein the parties agree as follows:


The parties agree that the foregoing recitals are true and correct and incorporated herein by reference:


The School Board will:

1. Transportation Department will work cooperatively with American Legion officials in order to arrange for a bus lease agreement for shuttle services for the Annual Boys and Girls State program.

2. Provide the use of school system facilities for American Legion functions/programs/contests as available, waiving the rental fee as per the Community Use of System Facilities Policy (KG).

3. Promote American Legion programs through existing communication channels, including nominating students for various American Legion awards, scholarships and contests.

4. Provide the opportunity for each of the high school JROTC programs to present the colors or conduct a drill and ceremony display at American Legion’s monthly meeting.


American Legion will:

1. Provide scholarship opportunities (including cost of program and transportation) for Cherokee County students to attend the annual Boys and Girls State program.

2. Provide JROTC awards for a student at each of the four high school JROTC programs on Honors Day/Night at their respective schools.

3. Conduct a middle school essay contest. Local winners receive a $50 United States Savings Bond.

4. Provide assistance and participation in school Veterans Day programs, as well as a United States flag to each school, as requested.

5. Conduct the American Legion School Awards program, honoring two students from each school with the American Legion School Medals Award. Each student is selected based on their patriotism, honor, service, courage, leadership and scholarship.

6. Conduct the American Legion National High School Constitutional Speech Contest at a Cherokee County school site during the upcoming school year. Winners at the local level can advance through district, state and national competitions.

7. Abide by the rules and regulations contained in the facility use contract at each facility and those contained in the Community Use of System Facilities Policy (KG), including custodial and supervisory fees when applicable.

8. Will work cooperatively with the School Board’s Transportation Department to arrange for a bus lease agreement and will provide proof of insurance and compensation for mileage and drivers, if necessary for shuttle service to Boys and Girls State.

9. Provide a list of veteran classroom speakers, activities to foster patriotic activities, and information relative to Flag Education and other American Legion educational activities/programs.

10. Provide information regarding American Legion scholarships to the counseling departments of each high school.

11. Accept all children/interested participants for participation within its programs without regard to their gender, race, political affiliation, age, national origin or handicapping condition. Children/participants with handicaps must be provided all necessary levels of supervision and must be included within the activities of the partnering organization. As a result of this partnership agreement, American Legion must adhere to all local, State or Federal laws regarding education.


The term of this contract is May 17, 2012 through May 16, 2013. This contract shall automatically renew for additional terms not to exceed five years unless either party notifies the other at least 60 days prior to renewal date.


This contract may be terminated by either party upon thirty (30) days written notice to the other party with or without cause. All notice of this contract shall be given to the Superintendent of Cherokee County Schools at 110 Academy Street, Canton, Georgia 30114, and to the Post Commander, American Legion, Post 45, P.O. Box 982, Canton, Georgia 3011469.
